Terms and Conditions for the Participation in the Registration Campaign
§ 1 Personal and Territorial Scope
For the business relationship between OM Digital Solutions GmbH, Willy-Brandt-Strasse 23, 20457 Hamburg, registered in the commercial register of the local court of Hamburg, Germany, under number HRB 163550 and with VAT ID number DE334687531 (hereafter: "OM Digital Solutions", "we", "us") and the customer ("you") registering for the email course ("Course"), the following Terms and Conditions (hereafter: "T&C") shall apply. OM Digital Solutions does not accept any deviating conditions of the customer unless OM Digital Solutions explicitly agrees to their application in writing.
§ 2 Content
The participation in the Course is provided by us. In exchange for your participation in the Course, you allow us to send you - subject to your withdrawal - our email newsletter. No additional fee is payable by you.
After registering you will have a chance to participate in our journey, which consists of six parts, that will inspire and teach you to see nature in a brand-new way. For this, you will receive six emails from us, each with a different focus that will all contain hands-on lessons in order to give you a fresh perspective on the world around you. The Course is intended to provide you with a new perspective, which is aimed to make you more attentive to details and ultimately help you become a better photographer.
§ 3 Registration and Acceptance of Newsletter

In order for you to register you have to provide us with your full name and email address. Before submitting the registration, you can view and change the data at any time. You have the option of see the contractual provisions including these T&C before completing the order process and saving them in reproducible form.
You make a binding offer to enter sign up for the Course as soon as you click on the "Sign Up" button. However, the order can only be sent and transmitted if you confirm acceptance of these T&C by ticking the corresponding checkbox.
- We will confirm receipt of registration submitted to you as well as your registration for the Course immediately by email and will list the content of the Course as well as our agreement (consisting of the registration and these T&C). This text will not be stored by us for retrieval by you after completion of the order process. The Course offer of OM Digital Solutions is not directed at minors. The contract is concluded in English or the applicable local language in the EU country you access the landing page from.
By registering for the Course you agree to receive our newsletter. If you no longer wish to receive our newsletter you can withdraw your consent at any time and free of charge by clicking here. You can unsubscribe the newsletter also by clicking on the unsubscribe link at the end of each newsletter. Your withdrawal of consent shall not affect the lawfulness of processing based on your consent before its withdrawal.
§ 4 Right of Withdrawal
Consumers have a right of withdrawal under the following conditions. A consumer is a natural person with whom a legal transaction is concluded primarily for a purpose that cannot be attributed to that person's commercial or self-employed activity.

Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire 14 days from the day on which you have received our confirmation email.
To exercise your right of withdrawal, you must inform us, OM Digital Solutions GmbH; Willy-Brandt-Strasse 23, 20457 Hamburg, e-mail [camera.support@om-digitalsolutions.com], phone number 0080067108300, of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form for this purpose, which is, however, not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we will delete your contact information and you will not receive any further Course emails by us, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.

§ 5 Liability
OM Digital Solutions shall be liable to you - irrespective of the legal basis - in the case of intent and gross negligence without limitation in accordance with the statutory provisions.
In the event of simple negligence, OM Digital Solutions shall only be liable for damages based on the breach of a material contractual obligation (obligation which makes the proper performance of the contract possible in the first place and on the observance of which you may regularly rely); in this case, however, the liability shall be limited to the foreseeable, typically occurring damage.
Insofar as the liability of OM Digital Solutions is excluded or limited, this limitation of liability shall also apply to the personal liability of OM Digital Solutions' employees, legal representatives, and vicarious agents.
The above exclusions and limitations of liability shall not apply if OM Digital Solutions has fraudulently concealed a defect or has assumed an explicit guarantee for the quality of the goods. The same applies to damages resulting from injury to life, body and health as well as to liability under the Product Liability Act.
§ 6 Governing Law and Dispute Resolution
These terms and conditions are subject to German law. If you are a consumer, the application of mandatory legal provisions of the country of your habitual residence shall remain unaffected by the choice of German law.

We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
